Terms of Service

1. The Seller
Fold (the "Service") is provided by Callum Spillett, a sole trader ("we", "us", "the Seller"). These Terms of Service (the "Terms") form a binding agreement between you and the Seller.
2. Acceptance of terms
By creating an account, purchasing a paid plan, or otherwise accessing or using the Service, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
3. Eligibility
You must be at least 16 years old and legally capable of entering into a binding contract in your jurisdiction to use Fold.
4. Payments — Paddle as Merchant of Record
Paid subscriptions to Fold are sold and fulfilled by Paddle.com Market Ltd ("Paddle") as our Merchant of Record. This means Paddle — not the Seller — is the merchant of record for your purchase and is responsible for:
- Processing your payment and issuing invoices/receipts.
- Collecting and remitting applicable sales tax, VAT or GST.
- Handling refunds, chargebacks and dispute resolution in accordance with our Refund Policy.

5. Subscriptions and billing
- Paid plans are billed monthly or annually in advance, based on the plan you select.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- You can cancel at any time from your billing portal (managed by Paddle). Cancellation stops the next renewal; the current period remains active until it ends.
- Prices may change; we will give you at least 30 days' notice of any price change affecting your subscription.
6. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Your content
You retain all ownership rights in the content you or your team upload to Fold ("Your Content"). You grant the Seller a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display and process Your Content solely to operate, secure and improve the Service. You are responsible for Your Content and for having the rights necessary to upload it.
8. Intellectual property
The Service, including all software, branding, designs, text, graphics, and other materials (excluding Your Content), is owned by the Seller or its licensors and is protected by copyright, trademark and other laws. Except for the limited licence to use the Service granted to you under these Terms, no rights are transferred to you. You may not copy, modify, reverse engineer, resell or create derivative works from any part of the Service without our prior written consent.
9. Acceptable use
You agree not to (a) use the Service for anything unlawful; (b) upload malware or attempt to breach the Service's security; (c) infringe others' rights; (d) send spam; (e) resell or provide the Service to third parties outside your workspace; or (f) use automated means to scrape or overload the Service.
10. Suspension and termination
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe that you have breached these Terms, that your account is being used unlawfully or fraudulently, or that continued access poses a risk to the Service, other users, or third parties. We will where reasonably possible give notice and an opportunity to cure. You may terminate at any time by cancelling your subscription and deleting your account.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.
12. Limitation of liability
To the maximum extent permitted by law, the Seller's aggregate liability arising out of or relating to the Service or these Terms is limited to the amount you paid to Paddle for the Service in the twelve months preceding the event giving rise to the claim. The Seller is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill.
13. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified in-product or by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights in your country of residence.
